2008 SESSION

The attached Education Bill was signed into
law by the Governor on July 1.
This Bill with the combined efforts of the
Rhode Island Motorcycle Association
and the very helpful Lobbyist for Harley Davidson
will allow outside contractors to offer Rider Education
for first time motorcycle licensees.
Up until now only the State Community College could offer the mandated Riders Education Program for license purposes.
 
    This was a three year project from its first conception,
through its many rewrites and then finally its passing.
 
    THEY MAY WEAR US DOWN BUT DON'T LET THEM WEAR YOU OUT.

Senate Bill S 2017 Sub A is now in the House Municipal Government Committee. As of today there is no hearing scheduled. This should not stop you from making calls to the committee members.

This is where we are with the RIMA bills.......
just this past Wednesday the full Senate voted and passed our designated parking bill.
Thanks to all that contacted thier senators on this issue, but that's only 1/2 the job done, now we need to pass the House...contact your Representatives ASAP.

The following is the status of the Bills that the RI Motorcycle Association is working on during this session.
 
H 7505 Mufflers -
This is being amended as we spoke about. I did get to see the draft and its as follows.
 
Making it louder than intended :
 
 1st offense not to exceed $100.00
                                              
 2nd offense not to exceed $250.00
 
 3rd and subsequent offenses not to exceed $750.00.
 
 We are keeping the laws as they are and amending the fines.
 
H 7648 & S 2426 Education - The House version has been redrafted but as of yet we have not seen it. All parties involved did agree on the wording. The Senate will amend theirs to match the House.
 
H 8011 & S 2146 - Right of Way - Both have been heard and are held for further study.
 
H 8012 & S 2017 Sub A  Parking - The Senate version passed the full Senate and is on its way to the House. The House version will be left to die and the Senate version will be heard.

DISCRIMINATION ON THE BASIS OF CLOTHING

OR CLUB MEMBERSHIP IS ILLEGAL

Rhode Island General Laws, Section 11-24-1, (1956, as amended), provides that "All persons within the jurisdiction of this state shall be entitled to the full and equal accommodations, advantages, facilities and privileges of any place of public accommodation, resort or amusement subject only to the conditions and limitations established by law and applicable alike to all persons." Further, any persons aggrieved by any violation of this statute has the right to petition the Rhode Island Commission on Human Rights to induce compliance. RL Gen. Laws Section 11-24-4 (1956, as amended).

The Supreme Court of the United States has ruled in the case of Cohen v. California, 403 U.S. 15 (1971), that persons have the constitutional right under the First Amendment to wear clothing which displays writing or designs. In addition, the right of an individual to freedom of association has long been recognized and protected by the United States Supreme Court Thus, a person's right to wear the clothing of his choice, as well as his right to belong to any club or organization of his choice is constitutionally protected, and persons or establishments who discriminate on the basis of clothing or club membership may be subject to lawsuit.
